Essure Birth Control Complications
Approved by the U.S. Food & Drug Administration (FDA) in 2002, Essure consists of 2 small coils which are inserted directly into a woman’s fallopian tubes. After being implanted, a barrier of scar tissue forms around the device which blocks sperm from reaching the eggs. Nickel Allergy Warnings
Some patients’ Essure side effects have been attributed to a pre-existing allergy to nickel. When the FDA approved Essure, it required a warning label recommending that women have a skin test for nickel allergies before receiving the implant. However, in July 2011, Conceptus (the company that originally designed Essure) presented studies which indicated that there was not enough nickel in Essure to produce an allergic response, and the warning was removed. The label now states that Essure “could be an option for women with nickel sensitivity.”
Victims of Essure allege that their health problems were ignored, and many claim they were discriminated against by doctors and the FDA. They allege Bayer is guilty of negligence for failing to warn of potential Essure side effects.
For women injured by the device, turning to the legal system may be the only way to be compensated for medical bills and lost quality of life. Many file lawsuits because they want to prevent the device from harming others.
Despite thousands of complaints over Essure, preemption laws protect Bayer from lawsuits. Preemption bars individuals from filing lawsuits against manufacturers because the FDA puts the device through a rigorous pre-approval process.
However, famed consumer rights advocate Erin Brockovich says she is passionate about getting these laws overturned when it comes to injuries allegedly caused by Essure.
“We need to hold companies accountable and in this situation Bayer can’t just turn their head and go ‘these 8,000 women don’t matter.’ I think that they have a responsibility, a duty, to take a look and, if there’s a question, pull it,” Brockovich said in an BBC interview. “One’s too many. Eight thousand women? You cannot disregard that voice collectively. There is something wrong with the product.”
